By accessing or using wickedsmart.app, our brain games and trivia features, or WickedSmart Daily (together, the "Site"), you agree to these Terms of Use. If you don't agree, please don't use the Site.

WickedSmart provides brain games and trivia (in part through our platform partner's trivia infrastructure), articles across several content categories, and an optional daily email newsletter. We may add, change, or discontinue any part of the Site at any time.

Your Use of the Site

You may use the Site for personal, non-commercial enjoyment. You agree not to: scrape, crawl, or use automated tools to access the Site beyond normal search-engine indexing; attempt to disrupt, overload, or interfere with the Site; reverse-engineer or attempt to extract the Site's source code; manipulate, cheat, or use automated means to affect trivia scores or leaderboards; impersonate any person or entity; upload viruses or malicious code; or use the Site in a way that violates any applicable law.

Contact Submissions

If you send us a message through our Contact form, you agree we may use it to respond to you and improve the Site. We won't publish your submission publicly or share it outside Inspiring Media without your permission, except as described in our Privacy Policy.

Email & Marketing Communications

Subscribing to WickedSmart Daily is opt-in, and you can unsubscribe at any time using the link at the bottom of any email. We may still send you occasional service-related messages (like a reply to a message you sent us) even if you've unsubscribed from marketing email.

Our Content & Intellectual Property

The articles, games, trivia, graphics, and branding on the Site belong to Inspiring Media, LLC (or our licensors) and are protected by copyright, trademark, and other intellectual property laws. You may view and share links to our pages for personal, non-commercial use. Please don't republish, redistribute, or create derivative works from our content without asking us first through our Contact page.

Third-Party Links & Advertising

WickedSmart is supported by advertising, including through Google AdSense. Ads are served by third parties, and their presence isn't an endorsement by us. The Site may also link to other websites we don't control; we aren't responsible for their content, accuracy, or privacy practices. Visit third-party sites at your own risk.

TO THE FULLEST EXTENT PERMITTED BY LAW, INSPIRING MEDIA, LLC AND ITS AFFILIATES WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE — REGARDLESS OF THE LEGAL THEORY — EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU'VE PAID US IN THE PAST 12 MONTHS (WHICH, FOR MOST USERS, IS $0). Indemnification

Dispute Resolution & Binding Arbitration

Please read this section carefully — it affects your legal rights. You and Inspiring Media, LLC agree that any dispute arising from these Terms or the Site will be resolved through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. YOU AND INSPIRING MEDIA EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION. Arbitration will be conducted by a single arbitrator under the rules of a recognized arbitration provider (such as the American Arbitration Association), in the state referenced below or another mutually agreed location, and each side generally bears its own costs. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first using the Site, stating that you decline to arbitrate disputes with Inspiring Media.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where arbitration rules described above apply.

Severability, Waiver & Entire Agreement

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision isn't a waiver of it. These Terms (with our Privacy Policy) are the entire agreement between you and Inspiring Media regarding the Site.

Termination

We may suspend or restrict your access to the Site at any time, for any reason, without notice — for example, if we believe you've violated these Terms.

Changes to These Terms

We may update these Terms as WickedSmart grows. We'll update the date at the top of this page whenever we do; continuing to use the Site after changes means you accept the updated Terms.
